By accessing or using the services of 1MobileNotary ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services.
These Terms apply to all visitors, users, and others who access or use our website and notary services.
2. Description of Services
1MobileNotary provides mobile notary public services, including but not limited to:
- Real estate document notarization
- Loan signing services
- Legal document notarization
- Power of Attorney notarization
- Medical document notarization
- Apostille services
- Remote Online Notarization (where legally permitted)
3. Scheduling and Appointments
When scheduling an appointment with 1 Mobile Notary:
- You agree to provide accurate and complete information
- You must have valid, government-issued identification at the time of notarization
- All signers must be present at the scheduled appointment time
- You are responsible for having all documents ready for notarization
4. Cancellation Policy
We understand that plans change. Our cancellation policy is as follows:
- Cancellations made 24 hours or more before the appointment: No charge
- Cancellations made less than 24 hours before the appointment: A cancellation fee may apply
- No-shows: Full service fee may be charged
Please contact us as soon as possible if you need to reschedule or cancel your appointment.
5. Fees and Payment
Fees for our services are based on:
- The type of notarization required
- The number of documents and signatures
- Travel distance and time
- Time of appointment (after-hours, weekends, holidays)
A quote will be provided before services are rendered. Payment is due at the time of service unless otherwise arranged.
6. Notary Responsibilities and Limitations
Our notaries are licensed and bonded professionals who:
- Verify the identity of signers
- Ensure signers are acting willingly and are aware of the nature of the documents
- Administer oaths and affirmations when required
- Complete the notarial certificate and affix the official seal
Important: Notaries cannot provide legal advice, prepare legal documents, or advise on the content of documents. If you need legal advice, please consult an attorney.
7. User Responsibilities
As a user of our services, you agree to:
- Provide truthful and accurate information
- Present valid identification
- Not engage in any fraudulent activity
- Not request notarization of documents you know to be false or fraudulent
- Treat our notaries with respect and professionalism
8. Limitation of Liability
To the maximum extent permitted by law, 1 Mobile Notary shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.
Our liability is limited to the amount paid for the specific service giving rise to the claim.
9. Intellectual Property
The content, features, and functionality of our website, including but not limited to text, graphics, logos, and software, are the exclusive property of 1 Mobile Notary and are protected by copyright, trademark, and other intellectual property laws.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and applicable state laws, without regard to conflict of law principles.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of our services after any changes constitutes acceptance of the new Terms.
